When you register with or use a
website operated by Insight Out of Chaos LLC (“IOOC” or “us”), including
PetStoreMarketer.com (the “Site” or “Sites”) or the features and functionality
that is available through the Site (such features and functionality, together
with the Site, are referred to in this Agreement as the “Services”), you
provide and IOOC acquires and uses certain information. Because IOOC values your privacy, it has
created this Privacy Policy to explain to you what information it collects, how
it protects and uses that information, and how you can access and update that
information.
Please read this Privacy Policy carefully. By using any portion of
the Services, you agree to the provisions of this Privacy Policy.
The
Information We Collect And Use
This Privacy Policy refers to several
different kinds of information.
“User
Information” is any
personally identifiable or anonymous information relating to you or your use of
any portion of the Services. User
Information includes Account Information and Contact Information (defined
below). User Information does not
include “Customer Information.”
If you register with and/or subscribe to services, you provide us with
Account Information. “Account Information” is any information
about you, your account, or your business, including your Contact Information (defined
below), billing information, and other account-related information that is
necessary or useful for us to manage your account, your access to special
features or services offered through the Services and privacy preferences.
“Contact
Information” means
information that allows someone to identify or contact you or your business,
including, for example: your name, address, telephone number and email address. When you register with IOOC, you provide us
with Contact Information.
“Customer
Information” is the
information about your customers that you maintain and store on the
Services. It includes any and all
information you collect from your customers, such as their name, address,
telephone number, email address, transaction history, and the like.
You
can browse the Site and use many features without registering or providing
personally identifiable information about yourself. There is information about your computer
hardware and software, however, that is automatically collected by IOOC. This
User Information can include your IP address, browser type, domain names,
access times and referring website addresses. This information is used by IOOC
for the operation of the Services, to maintain quality of the Services, and to
provide general statistics regarding use of the Services.
When
you register with the Site or subscribe to the Services, you provide IOOC with Account
Information. If you subscribe to the
Services, you can store, manage, and manipulate Customer Information. If you use the Services to create and send
communications to your customers, IOOC collects and tracks that information,
and we similarly collect and track information that is generated when customers
respond to such communications.
The
Services may allow users to create profiles and post or transmit messages, comments,
computer files, and other materials. IOOC does not monitor such transmissions,
and therefore IOOC cannot be responsible for any personally identifiable
information or other User Information that may be contained in such
transmissions. Please keep in mind that if you directly disclose personally
identifiable information or personally sensitive data through public message
boards or forums, this information may be collected and used by others.
IOOC may retain communications relating to customer
support, and/or information drawn from such communications, for statistical
and/or reference purposes.
We
Use Cookies And Web Beacons
A
“cookie” is a text file that is sent from a web server to your browser and is
stored on your computer’s hard drive.
Like most websites, the Services may use “cookies” and web log files to
help personalize your online experience. One of the primary purposes of cookies is to
provide a convenience feature to save you time. The cookie tells the Web server
that you have returned to a specific page, and it allows IOOC to display
information consistent with your settings and preferences. For example, if you register
for the Services, a cookie helps the Services to recall your specific
information on subsequent visits. This simplifies the process of recording your
Account Information, such as billing addresses, shipping addresses, and so on.
You
have the ability to accept or decline cookies. Most Web browsers automatically
accept cookies, but you can usually modify your browser setting to decline
cookies if you prefer. If you choose to decline cookies, you may not be able to
fully experience the interactive features of the Services. You can also erase cookies from your

screen or manual should thoroughly explain this process.
Web Beacons
Web
pages may contain electronic images (called a “single-pixel GIF” or “web beacon”)
that are used to count users who have visited that page, or to access certain
cookies.
Information
about your visits to the Site, such as the number of times you have viewed an
ad, may be used to serve ads to You. In addition, IOOC may share Site usage
information about visitors to IOOC’s sites with IOOC’s web advertising partners
for the purpose of managing and targeting advertisements and for market
research analysis on the Sites. Once you
have clicked on an advertisement and left the Site, the Privacy Policy no
longer applies and you should read the privacy policy of the advertiser to see
how your personally identifiable information will be treated on its site.
If
you use the Services to create and send communications to your customers, those
communications may include web beacons to enable IOOC to collect and track
information about customer responses to such communications.
Communications
From Us
IOOC
may communicate with you through email and notices posted on the Site or
through other means available through the Services. The email communications may relate to the
proper functioning of your account and the Services, or they may maintain promotional
information.
Use
of Customer Information
You
can use the Services to store, manage, and maintain Customer Information. IOOC may use and disclose Customer Information
(including personally identifiable Customer Information) to send communications
at your request or on your behalf. IOOC may analyze, data-mine, and otherwise
manipulate de-identified and aggregated Customer Information, and it may use
and exploit any reports, compilations, or analyses that it creates
(collectively, “Analyses”). IOOC may use
and disclose such Analyses, but it will not disclose any
personally-identifiable Customer Information in such Analyses.
How
We Protect Your Information
IOOC
uses commercially reasonable means, including technological, administrative,
and/or physical safeguards, to protect the confidentiality of User Information
and Customer Information. For instance, IOOC
stores User Information and Customer Information on computer servers that are
maintained in a controlled, secure environment, and IOOC takes commercially
reasonable measures to protect those servers and your User Information and Customer
Information from unauthorized access, use or disclosure. When personal
information (such as a credit card number) is transmitted to other websites, it
is protected through the use of encryption, such as the Secure Socket Layer
(SSL) protocol.
No
method of safeguarding information is perfect, however, and IOOC cannot and does
not guarantee that your User Information and Customer Information will be 100%
secure.
Sharing
Information with Third Parties
IOOC does not rent, sell, or share
personally identifiable User Information or Customer Information with other
people or non-affiliated companies except to provide products or Services that
you have requested, or when IOOC has your permission, or under the following
circumstances:

addition, IOOC may, from time to time, contact you on behalf of external
business partners about a particular offering that may be of interest to you.
In those cases, your Contact Information is not transferred to the third party
unless IOOC has your consent. IOOC may share User Information with trusted
partners to help IOOC perform statistical analysis, send you

does not collect, use, or disclose sensitive personal information, such as
race, religion, or political affiliations, without your explicit consent.
Accessing and Changing Your User
Information
You
can review and make changes to the User Information that you provided to IOOC at
any time by logging in to your account. Please be aware that even after your
request for a change is processed, IOOC may, for a time, retain residual
information about you in IOOC’s backup and/or archival copies of its database.
If you provide IOOC with User Information, you have the
following rights with respect to that information:
If
you request that your User Information
be deleted from IOOC’s records, there may be a brief delay in IOOC’s processing
that request, while IOOC verifies that the request is valid and originates from
you as opposed to an unauthorized third party.
Please note that if you request that your User Information be deleted, IOOC shall have the
right to terminate and/or limit your access to the Site.
If
you terminate your subscription to the Services (pursuant to the terms of your
subscription), IOOC may retain your User Information in its records for IOOC’s
business purposes.

exercise any of these rights, please send your request to CustomerService@PetStoreMarketer.com. Please send your request using
an email account that you have registered with the Site under your name.
Opt-Out
Procedures
When
you register for the Services, IOOC may ask you for your marketing
preferences. You can opt out of having your
Contact Information shared with third parties for marketing purposes or from
receiving marketing and promotional materials from IOOC. You can also edit your marketing preferences
at any time to opt out of receiving such marketing materials.
From
time to time, new categories of marketing communications might be added to the
marketing preferences page. Users who visit this page can opt out of receiving
future marketing communications from these new categories or they can
unsubscribe by following instructions contained in the messages they receive.
IOOC
reserves the right to send you certain communications relating to the Services,
such as service announcements and administrative messages that are considered
part of account, without offering you the opportunity to opt out of receiving
them.

include your name, email address and the specifics of your request. However, after
you opt-out IOOC or its trusted partners may continue to contact you via email

regarding the administration of your account, any Services, features or
functions you have enrolled in or registered to use, any promotions you have
participated in or have entered, goods and/or services you have ordered, or
other transactions you have undertaken through the Services.
Changes
to this Privacy Policy
IOOC
may update this Privacy Policy from time to time to reflect company and
customer feedback. IOOC encourages you to review this Privacy Policy
periodically to be informed of how IOOC is protecting and using your
information. When such a change is made,
IOOC will update the “Last Updated” date above, and it may, but is not required
to, send you an email or post a notice on the Site.

IOOC will use commercially reasonable efforts to respond.
Residents of the State of
IOOC qualifies for this
alternative option: it has a
comprehensive privacy policy and provides you with details on how you may
either Opt-out or Opt-in to the use of your personally identifiable information
by third parties for direct marketing purposes (see “Opt-Out Procedures”
above). Therefore, IOOC is not required
to maintain or disclose a list of the third parties that received your
personally identifiable information for marketing purposes during the preceding
year.
